Yampitheater General Release of Liability and Assumption of Risk

In exchange for the opportunity for me and/or my child/ward to participate in the offered activities of the Yampitheater Playhouse at 1111 West Victory Way #119 of Craig, CO, I, for myself and on behalf of my child/ward, and if applicable, heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS the Yampitheater Playhouse and its respective directors, officers, employees, sponsors, donors, or volunteers (the “Indemnified Parties”) FROM AND AGAINST ANY AND ALL INJURY, DISABILITY, DEATH, loss, damage to person or property, claims, causes of action, or demands relating to or arising out of my and/or my child’s/ward’s participation, WHETHER ARISING FROM NEGLIGENCE OF THE INDEMNIFIED PARTIES OR OTHERWISE, to the fullest extent permitted by law.

I acknowledge the risk of injury to me and/or my child/ward, if applicable, from the activities involved at Yampitheater Playhouse and include the potential for permanent disability and death, and while particular skills and personal discipline may reduce this risk, the risk of serious injury does exist. I, FOR MYSELF AND ON BEHALF OF MY CHILD/WARD, IF APPLICABLE, HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN, KNOWINGLY AND EXPRESSLY ASSUME SUCH RISKS, both known and unknown, HOWSOEVER CAUSED OR ARISING AND WHETHER BY NEGLIGENCE OF THE INDEMNIFIED PARTIES OR OTHERWISE, and accept personal responsibility for the damages following such injury, permanent disability or death.

In an emergency, I grant permission to representatives of the Yampitheater Playhouse the authority, at my expense, to utilize the most convenient emergency medical service.

Youth Choir, Community Theater, and Other Program participants involving a recital or show grant full permission to the Indemnified Parties to use, without further notification, authorization or compensation to me or anyone on my behalf, my and/or my child’s/ward’s, if applicable, name and likeness, as well as any photographs, audio, videotapes, motion pictures, recordings, or other record of my and/or my child’s/ward’s, if applicable, during participation in the activities in any and all media, whether now known or hereafter to become known or developed, worldwide and in perpetuity. I also represent and warrant that no further permission is required for the Indemnified Parties to use my and/or my child’s/ward’s participation as provided, or otherwise exercise the rights granted herein.

I hereby represent and warrant that I have full authority to execute this General Release. If any portion of this General Release of Liability and Assumption of Risk Agreement is found to be unenforceable or invalid, that portion shall be severed and the remainder shall remain in full force and effect. I also represent that I am eighteen (18) years of age or older and, if applicable, am the parent or legal guardian of the participating minor(s) whose name is printed below.

I HAVE READ THIS GENERAL RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND FULLY UNDERSTAND THE TERMS AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

IN SHORT, I hereby acknowledge this release from liability for accidental injury or illness which I may incur as a result of participating in any physical activity. I hereby assume all risks connected therewith and consent to participate in this program. I agree to disclose my physical limitations, disabilities, ailments, or impairments which may affect my ability to participate in this program.

Yampitheater Code of Conduct and Behavior

In the Yampitheater Playhouse, whether using the play area facilities or participating in the youth choir, community theater, or other established programs, as the legally responsible adult for the above-named child/ren:

I will ensure my child/ren remove their shoes before playing in the play area. I will also remove my own shoes if I choose to play with them.

I will ensure that my child/ren behaves appropriately and respectfully towards others and the Yampitheater facilities. This includes watching out for others as they run, jump, and climb, and that they will not abuse the play equipment and facilities with excessive roughness.

I will keep any snacks/food/drinks I bring within the boundaries of the hard floor snack area and wipe hands and faces BEFORE my child/ren returns to playing. I understand that NO FOOD OR DRINK OF ANY KIND IS ALLOWED ON THE PLAY EQUIPMENT OR BACK STAGE.

I will also ensure that MY behavior is respectful and conscientious toward the Yampitheater staff and other patrons of the facility. This includes cleaning up after my child/ren should they make a mess with any food, drink or bodily functions. In addition, I will alert a staff member to check that my cleanup has been sufficient.

While using the Yampitheater playground area, if my child/children are under 8 yrs old, I will bodily remain at the facility within eye contact of my child/ren at all times and remain alert and conscious as to their actions and activities.

I will observe all rules of the facility as they are posted and help my child/ren to follow them as well. I understand that failure to adequately supervise my child/ren and ensure their proper behavior while enjoying the Yampitheater facilities may result in ejection from the Yampitheater without refund. I also understand that continued infractions may result in long-term banning from the facility.

I WILL encourage my child/ren to play, share, imagine, create, dream, and help others within the Yampitheater facility and without as I guide them by my own conscientious example.
